POWER OF ATTORNEY

The Passenger according to “PASSENGER.AM” LLC General Terms and Conditions, EU 261/2004 regulation, Montreal Convention (1999) and other international legal acts, as well as according to the legislation of the Republic of Armenia, hereby authorizes “PASSENGER.AM” LLC to act and to submit/lodge an application (which may contain an application, a complaint, a claim, plaintiff or other lawful action) on behalf of the Passenger, in the scope of the above mentioned legal acts, for the purpose of delayed and/or cancelled flight(s), denied boarding of the Passenger, as well as in the scope of other national and international legal acts in the field of Passenger transportation, to claim reimbursement and/or compensation (including cancelled flight ticket costs, baggage issues as well as other issues arising in the field of international transport law) from the air carrier or any other person concerned (state and non-state bodies, insurance company, bank, service organization, etc.), request, obtain and receive other relevant information.

The Passenger ipso jure hereby authorizes “PASSENGER.AM” LLC to require from the air carrier (or the equivalent defendant and/or co-defendant) not to disclose the personal data information of the Passenger as stipulated by the respective laws of personal data protection of the European Union, the country of registration of the defendant, the Republic of Armenia and international legal acts, with the exception of case(s) when this data is used and required to verify the claim and/or the application.

Hereby the Passenger grants exclusive and full Power of Attorney to “PASSENGER.AM” LLC

 

• to represent the Passenger in the scope of her/his case with the air carrier or the equivalent defendant and/or co-defendant or other legal or natural person concerned and with the third parties;
• to receive any kind of information, as well as to initiate information inquiries regarding any policies/procedures, reports and to submit claims/complaints to respective bodies and courts;
• to initiate, proceed and negotiate fully on her/his behalf, including of judicial and extra-judicial and out-of-court proceedings, alternative dispute resolution and court proceedings;
• require the air carrier (or the equivalent defendant) and/or other person(s) involved not to use and process personal data information or other equivalent information of the Passenger as stipulated by the respective laws of personal data protection and the international legal acts related to, with the exception of case(s) when this data is used and required to verify the claim and/or the application;
• to require and receive compensation, reimbursement or other payments and information in the scope of her/his case or related case(s) on behalf of the Passenger;

The Passenger is hereby notified about the responsibility for providing (obvious) false information set forth by the legislation of the Republic of Armenia or by the legislation of the Country of the main residence of the Passenger.

I read, understood and accepted all the conditions for which I have signed.

ONLINE SERVICE (ONLINE / ELECTRONIC) CONTRACT

The Passenger on one hand, and the “PASSENGER.AM” LLC, represented by its Director on the other hand, hereinafter “Parties”, signed and concluded the following contract:

1. Hereby the Passenger gives/grants exclusive and full power of attorney/authorization to PASSENGER.AM LLC to fully process the application on behalf of the Passenger according to the Power of attorney;

2. The Passenger agrees and hereby confirms that Passenger.am LLC has the right to require from the air carrier any possible compensation within the scope of and related to his/her application, to which the same conditions apply.

3. The Passenger agrees and hereby confirms that from the moment of applying to PASSENGER.AM LLC, the case is deemed to have been transferred to PASSENGER.AM LLC and in case of any compensation received by the air carrier from that day, PASSENGER.AM LLC keeps the service fee at least 25 (twenty-five) percent, unless other actual additional necessary expenses have been incurred (for example telephone, fax, abroad postage expenses etc.).

4. The Passenger agrees and undertakes that from the moment of applying to PASSENGER.AM LLC he/she cannot accept any payment or other benefit (directly or indirectly) within the scope of the application from the air carrier or the equivalent person and/or other related person and/or another person interested in the outcome of the case. However, if the Passenger receives compensation directly to his/her bank account or in other way after the transfer of the case (claim) to the Passenger.am, the Passenger is obliged to present all the evidences of such compensation for the purpose of transparency and mutual fulfillment of the terms of the bilateral contract.

5. If from the moment of applying/signing/ to Passenger.am LLC by/with the consent and/or involvement of the Passenger, within the scope of and related to the application (claim, complaint, plantiff etc) submitted on behalf of the Passenger by Passenger.am LLC, the Passenger accepts any form of compensation, payment or other privilege from the air carrier (or the equivalent or other related person) or a promise to provide the above mentioned, then the Passenger hereby expressively undertakes to compensate Passenger.am LLC, within 15 days, at least the equivalent of the amount of money that Passenger.am LLC could receive in the form of service fee according to its General Terms and Conditions in case of winning the case or a positive outcome of the case.

6. PASSENGER.AM LLC charges the service fee only in the case of partial or complete satisfaction of the application if there is no other agreement between the Parties;

7. The Passenger accepts that he/she cannot accept any form of compensation, payment or privilege or advancing conditions with regards to his/her application or related applications from the air carrier (or the equivalent person or other beneficiaries in the scope of or the affiliate cases) without the prior and written consent of PASSENGER.AM LLC. The suspension and termination of the Power of attorney on the initiative of the Passenger, until the receipt of compensation or the receipt of a promise or assurance of compensation in any other way, does not release from the fulfillment of the obligations assumed by the Parties in the scope of the case.

8. Each of the parties (The Passenger and the PASSENGER.AM LLC) is hereby notified about the responsibility set forth by the legislation of the Republic of Armenia for providing (obvious) false information and violation of the provisions of this contract and power of attorney.

9. I read, understood and accepted all the conditions for which I have signed.
